You’ll receive a biometric notice from USCIS if you need to re-do it. Once your PD becomes current, you will want to stay on top of it by contacting USCIS and making sure it isn’t stuck somewhere.

It is country dependent. You can see the history of the F4 category cutoff date movement here: http://immigrationroad.com/visa-bulletin.php (use the Visa Bulletin by Country and Preference tool)

You meant the re-entry permit? Just getting the permit doesn’t reset your clock – it is primarily how long you’ve been outside the U.S. that counts, whether you use it or not.

In my personal opinion your best option would be to find a new job ASAP, or change your status to another non-immigrant category such as F or B before your H-1B ends.

It sounds like your H-1B officially started on Oct. 1, 2011. If your OPT was approved before that date, it would have been voided once H-1B kicked in (when your H-1B officially…[Read more]

  • It is possible, but with higher risks. For example, it will be very difficult to get another F-1 visa stamp should you leave the U.S. and then seek re-entry in the same status.

Very interesting question. I’m not 100% sure, but if I had to guess I would say no. The reason is that, as you already know, being in F-2 status means you are not permitted to be employed under any conditions, including self-employment and part-time work for financial or other types of compensation. Although certain passive activities are…[Read more]

    See here: http://immigrationroad.com/visa-bulletin/visa-bulletin-by-preference.php?vb-country=India&vb-preference=F3&preferenceSubmit=Get+Bulletin

India F3 cutoff date has been advancing steadily in recent months (roughly 3 weeks each time), so you can estimate how long it would take for your turn. Also DOS may initiate the process a bit earlier.

  • For non-immigration visas, it is usually the last action that determines your status. If you come to U.S. on F2, and later change your status to H-1B, then yes you will be able to work under H1. You want to inform […]

You must have an immigrant petition filed on your behalf in order to apply for K3 visa, which means that you have clear immigrant intent making it almost impossible to enter on a B1/B2 visa. In another word, if you have clear intention to stay permanently (by getting married) when entering on B visa, it is not going to go well, either at the Port…[Read more]

When you said your L1b would expire on Sep 2012, I assume you meant the visa (the stamp page on passport) and not your L1 status. Your non-immigration status and how long you can stay in the U.S. legally is determined by I-94 – not your visa.

If you re-enter the U.S. under “Automatic Visa Revalidation,” and thus no new I-94 is issued to you,…[Read more]

    Hi Glenn,

You asked a question on the forum rules page, not the forum itself. But anyway, I think your best bet is to contact USCIS directly with regard to your reinstatement request. If a decision was already made, USCIS customer service should be able to tell you what it was and where it was mailed to. Below you can find their contact phone…[Read more]

The law governing this issue is “Section 625 of Public Law 104-208.” You can try google it for more information. It states that F-1 students attending public schools must pay full tuition (along with other restrictions), but dependents of long-term nonimmigrants are not restricted by the new provisions.

My understanding is that an F-2 student would be able to attend public primary/secondary schools (high school or below) just like other residents. Fee is minimal since it is public education. As a comparison, an F-1 student attending high school (no elementary school for F1) must pay full tuition.

There isn’t much information on this subject on…[Read more]
