My visa as a full time student expires in May. But I have received a letter of employment offer requiring me to take up a full time Job from Aug. Can someone please advise me how to extend my stay until Aug before change of status

Did your visa (stamp on your passport) or your student status expire? Your visa stamp doesn’t matter, as long as you maintain full F status. One way to fill a “gap” is to apply for OPT, then have your employer acquire H-1B status for you. If you have already completed your study and are thus out of status, you may be accruing unauthorized stay…[Read more]

Yes, it should be AOS. Be sure your enter your I-485 Receipt Number and I-140 Approval number in the additional text section (if filing online) and send out the hard copies in the mail.

I think it should be Adjustment of Status, since AOS is the basis for your eligibility for EAD. Did you have EAD before, or enter the US with AP?

I’m attempting to file an I-765 and need clairification on the application question “Current Immigration Status” I am a holder of an L1-A visa with an approved I 140 and have a pending I 485. So I’m not sure if I put “Non Resdient Alien” or “Adjustment of Status AOS”

    Any insight????
