Can I enter in SUA with mt B1/B2 visa until my K3 visa is ready? I am a romanian citizen going to get married to an american citizen. After I will get married I will apply for K3 visa, but until that is ready can I enter and reenter in SUA with my actual B1/B2 visa?
And is there any difference between getting married in SUA or in Romania…[Read more]

    • You must have an immigrant petition filed on your behalf in order to apply for K3 visa, which means that you have clear immigrant intent making it almost impossible to enter on a B1/B2 visa. In another word, if you have clear intention to stay permanently (by getting married) when entering on B visa, it is not going to go well, either at the Port…[Read more]

Hi, I have the valid L1B and it expires on Sep 2012 but my I 94 expires only on July 2014. I planned to visit Niagara Canada by road and heard that they won’t give any new I 94 at POE Detroit.
    1. What would be my last entry date to US?
    2. Should I mention the date as I got the I 94 or the date I entered at Detroit by Road?

    Also When should I…[Read more]

    • When you said your L1b would expire on Sep 2012, I assume you meant the visa (the stamp page on passport) and not your L1 status. Your non-immigration status and how long you can stay in the U.S. legally is determined by I-94 – not your visa.

If you re-enter the U.S. under “Automatic Visa Revalidation,” and thus no new I-94 is issued to you,…[Read more]

I have read that the child of a parent in the US on F-1 visa is allowed to attend public school on F-2 dependent visa but it’s unclear whether the parent of that child has to pay tuition or can attend the public school free of charge. The dependent child in this case is 15 years old. I would appreciate any information related to this issue or…[Read more]

    • My understanding is that an F-2 student would be able to attend public primary/secondary schools (high school or below) just like other residents. Fee is minimal since it is public education. As a comparison, an F-1 student attending high school (no elementary school for F1) must pay full tuition.

There isn’t much information on this subject on…[Read more]

      • Thank you for your response. Actually I have already contacted both the high school and the school district. I was told by the high school that the student would be required to pay full tuition on an F-2 visa. When I called the school district, they didn’t even know what an F-2 visa was! Any suggestions on where to go from here? Thank you

        • The law governing this issue is “Section 625 of Public Law 104-208.” You can try google it for more information. It states that F-1 students attending public schools must pay full tuition (along with other restrictions), but dependents of long-term nonimmigrants are not restricted by the new provisions.

Here is the paragraph from DOS…[Read more]

I went to an infopass appointment and they said they would go get the liason but the immigration officer said that that person was not there. Should i make another inforpass appointment. The immigration officer just said that they were going to interview me and that my file was upstairs in the field office.

    • So they said your files were upstairs and what happened next? Did they go fetch them? Did they tell you to come back at another time?

      • No they did not go get them to show them to me. The person did not tell me to come back at another time. However, I did make another appointment to see if the liason is there this time I go to talk to them. What do you think I should say or ask them?

        • Well, I don’t know the details of your case or what questions you had before making the appointments. But good luck with your application and hope you get it soon.

          • Yeah my case is complicated because we married during removal proceedings but we were living together before he was brought in by ICE. He was brought by ICE because where we live they have that 287g program where if you get taken in they ask you if you are here legally or not. We have a daughter now. I sent in the I 130 petition before my husband…[Read more]

Does anyone have experience with ”porting” to self employment per the AC21 memos? I received notice that my I-485 was approved back in October 2008, followed by a letter stating there were no visa numbers:)
I am trying to establish all possible options as I wish to change employment.

    • Generally speaking, you can. But it is a complicated matter and there are many things to consider. For example, the company structure you are going to form. Who will be the owner(s)? What job functions you (as the owner and/or employee) will perform. And so on….

The USCIS memo linked below may be helpful, check out Question 8 in…[Read more]
